The following are the Conditions of Use of ALBEA BLANCA´s website by a USER and the contractual document that will govern the Terms of Sale of ALBEA BLANCA´s products and services by a CUSTOMER, through the domains www.albeablanca.com / www.albeablanca.es / www.albeablanca.org owned by the company illán AB ubago, SL.
In compliance with the duty of information contained in article 10 of the Spanish Law 34/2002, of July 11, Services of the Society Information and Electronic Commerce, from now on all the data of ALBEA BLANCA are reflected.
The acceptance of this document implies that the user/client:
1. Has read and understands what is stated here.
2. Is a person of legal age, with enough capacity to contract.
3. Assumes all the obligations set forth herein.
4. Accepts that the exposed Conditions will have an indefinite period of validity and that they will be applicable to all the agreements carried out by its part through ALBEA BLANCA´s website.
ALBEA BLANCA reserves the right to modify these Conditions unilaterally, without affecting the goods or promotions prior to the modification.
ALBEA BLANCA also reserves the right to make, without prior notice, the modifications it deems appropriate in its portal, being able to change, delete or add both the contents and services provided through it, and the way in which these are presented or located.
The following General Conditions of Use and Sales Conditions are established between:
On the one hand, the Mercantile Company "illán AB ubago, SL", with address at Paseo del Pinar 7, 1º izq., 28231 Las Rozas, Madrid, Spain, and with VAT number B-87660551 Registered in the Mercantile Register of Madrid, in date 12-19-2017, sheet nº M-659929, page 61, inscription 1, volume 36883 (hereinafter, ALBEA BLANCA)
And, on the other hand, any natural or legal person who:
1. Access and use ALBEA BLANCA´s site, hereinafter, the USER;
2. Place an order for products or services to ALBEA BLANCA, hereinafter, the CUSTOMER.
The Conditions of Use will be applicable regardless of the Sales Conditions.
The following portals/domains, linked together, are the property of ALBEA BLANCA:
These domains provide access to the USER/CUSTOMER to a multitude of information, hereinafter, CONTENTS, which belong to ALBEA BLANCA.
The USER assumes responsibility for the use of these portals, which extends to the registration that is necessary to access certain services or information; and undertakes to make appropriate use of the content offered by ALBEA BLANCA. And with an enunciative but not limiting character, it undertakes not to use them to (i) engage in illegal activities, illegal or contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, pornographic-illegal nature, advocating terrorism or attacking human rights; (iii) cause damage to the physical and logical systems of ALBEA BLANCA, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical systems that are capable of causing the aforementioned damage; (iv) try to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages.
ALBEA BLANCA reserves the right to withdraw all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that attempt against youth or childhood, order or public safety or which, in their opinion, are not suitable for publication. In any case, ALBEA BLANCA will not be responsible for the opinions expressed by users through forums, chats, or other participation tools, and will pursue the breach of these conditions, as well as any improper use of its portal, exercising all civil and criminal actions that may correspond by law.
ALBEA BLANCA reserves the right to deny or withdraw access to the portal and/or the services it offers without prior notice, at its own request or by a third party, to any USER who fails to comply with these General Conditions of Use and Sale.
The Conditions of Sale are applicable exclusively to final consumers and in no case is allowed the resale of the purchased products. For distributors and importers there are other conditions of sale stipulated separately. Information may be requested by phone or email, using the telephone number and/or email address available in the "contact" section of ALBEA BLANCA´s website.
The realization of an order to ALBEA BLANCA by a CUSTOMER, implies the acceptance of these General Conditions of Sale, as well as that of any other condition specified in the order itself.
Total Agreement: These Conditions of Use and Sale constitute the total agreement between the referring parties. If one of the clauses of these conditions is null and void, will not affect the rest of the conditions.
The purpose of these General Sales Conditions is to define the sales modalities between the CUSTOMER and ALBEA BLANCA, from the execution of the order, its delivery and payment, to the after-sales service.
2. Placement of an Order
2.1. The CUSTOMER can place an order through the following means:
1) Online store: Via Internet, through the website www.albeablanca.es, following the procedure established in the online store.
2) Via email, through the email address email@example.com
3) Via telephone, through the Spanish telephone number (+34) 679 431 934, in the following ways:
a) Making a voice call (Free for Spanish calls. International calls will have the cost the CUSTOMER has stipulated with its telephone operator);
b) Sending a text message, SMS (the cost of the message will be the one that the CUSTOMER has contracted with its telephone operator)
c) Sending a message through WhatsApp (free)
2.2. For the placement of an order by any of the proposed means, the CUSTOMER must provide the personal data requested. There are some obligatory fields, such as the name and surname, the email address and the contact telephone number, specified in the form to be filled out in the online store, and which will be requested if the order is made by another way. These personal data are requested to:
a) Facilitate the courier company the delivery of the order;
b) Correctly manage the receipt/invoice of the order by ALBEA BLANCA.
2.3. The products are chosen according to those available in the online store or on ALBEA BLANCA´s website. Once chosen, ALBEA BLANCA informs of its price, including VAT expenses if the purchasing is in Spain, and shipping cost. If the CUSTOMER accepts, then must specify the delivery address and enter payment details.
2.4. For orders placed outside the online store, the CUSTOMER has the option to customize it, choosing any of the packaging detailed below, in section 5.3. ALBEA BLANCA will inform of the total cost of the order, and once accepted by the CUSTOMER, will request its contact details, shipping address and payment details.
2.5. Once the order has been paid, the sale contract with ALBEA BLANCA is formalized. The execution of the order by the CUSTOMER is equivalent to the full acceptance of the prices, the description of the products and the General Conditions of Sale, as well as of any other specification stipulated in the order.
2.6. REGISTRATION as a CUSTOMER: Once the ordering process has been completed, the CUSTOMER can choose to:
a) Remain NOT REGISTERED: in this case none of the personal data will be saved in the online store for a future purchase.
b) REGISTER as a CUSTOMER: it means saving the personal data, billing details, delivery address and payment, for subsequent occasions of browsing on ALBEA BLANCA websites. The CUSTOMER will be responsible for providing truthful and lawful information. The data to be provided are, minimum, the obligatory ones stipulated by ALBEA BLANCA. The CUSTOMER will personally choose a password, for which will be responsible, committing itself to make diligent and confidential use of it. If the CUSTOMER does not remember the password at any time, ALBEA BLANCA will send an email with the account´s recovering procedure. The CUSTOMER can unsubscribe as "registered" whenever he wishes, by any of the forms specified below, in section 8.7.
2.7. All products are subject to its availability. The CUSTOMER can view the availability of the items in the space dedicated to each product individually at ALBEA BLANCA´s online store. If the order is placed through another channel, in case there are difficulties in the supply of the selected product, ALBEA BLANCA will inform the CUSTOMER in writing within two (2) days.
2.8. If it is impossible to supply a product once paid, ALBEA BLANCA will reimburse the CUSTOMER for the amount paid for that concept and the proportional transport cost, in the bank account that it determines.
3.1. Scope: The delivery of orders of products, not baskets, may be:
- National: throughout the Spanish territory, consisting of the Peninsula, Balearic Islands and Canary Islands;
- International: in foreign territory (inside and outside the European Union)
- The baskets will only be delivered in Madrid city and environs.
a) If the order is through the online store, it is mandatory that delivery will be “door to door” through the delivery service hired by ALBEA BLANCA: Packlink. This company uses different courier companies to adjust to each type of delivery and destination.
b) If the order is made by email or phone, ALBEA BLANCA would contact the CUSTOMER to determine the type of delivery, its cost and transit time.
3.3. Home delivery / Door to door:
a. Once the order is completed, by any of the possible means offered by ALBEA BLANCA, the CUSTOMER will receive an email informing that the order has been sent, when is the delivery estimated, the company that will deliver it, and its tracking number. The CUSTOMER may request more information about the shipment by responding to the aforementioned email.
b. The carrier will appear with the order at the indicated address. In case of absence of the CUSTOMER at the indicated address, the carrier will leave a notice, and will try a second delivery.
3.4. Other types of deliveries: to receive the order in a different way to home delivery by means of a courier hired by ALBEA BLANCA, the CUSTOMER must request it by email firstname.lastname@example.org or telephone (+34) 679 431 934.
3.5. Transit/delivery time:
- For peninsular services the transit time will be from 1 to 3 days.
- In services outside the peninsula, the transit time can vary from 3 to 6 days.
3.6. Unless there are circumstances arising from the personalization of the products, or unforeseen, or extraordinary circumstances occur, ALBEA BLANCA will send the order consisting of the related product/s in each shipment confirmation within the indicated period and in the described manner.
4.1. The CUSTOMER may choose among the following payment methods, accordingly to the way in which the order has been placed:
a) Credit card: for any of the ways of placing an order. No additional cost for the CUSTOMER. You can chose different credit cards than those offered on the online store. Ask for information via email.
b) PayPal or bank wire transfer: only if the order is placed by email or telephone. The cost for the CUSTOMER varies:
- Paypal has an additional cost for the CUSTOMER of 5% on the total value of the order, including VAT, if applied.
- Bank wire transfer may have an additional cost to the CUSTOMER of up to 1% of the total value of the order, including VAT, if applied. Ask for information. Depending on the order´s type and volume, and on the money´s country of origin, this additional cost may NOT arise. ALBEA BLANCA´s bank account number, under the company´s name "illán AB ubago, S.L." at Caixabank´s office #4082 is the following: ES68 2100 4082 0122 0020 3247 with swift code CAIXXXX. To better control payments, it´s important to indicate as the transfer concept the CUSTOMER´s name and the invoice/order number that is paying.
4.2. To make a secure payment through Paypal, the CUSTOMER expressly consents the communication of its personal data (name, surname, address, purchased product and its amount, total amount, date of purchases at ALBEA BLANCA´s online store, delivery address, email address, date of birth and its ID number) to Paypal.
4.3. To make a secure payment by card through Redsýs/Paygold, the CUSTOMER expressly consents the communication of its personal data (name, surname, address, purchased product and its amount, total amount, date of purchases at ALBEA BLANCA´s online store, delivery address, email address, date of birth and its ID number) to Caixabank, office #4082 at C/ Las Damas 1, 28412 Madrid (company specialized in credit for the consumer who wants to make secure purchases in internet portals) to be incorporated into their file for the purpose of analysis and, if applicable, management of the credit granted for the purchasing of the product/s.
5.1. Pricing in Spain includes the corresponding Spanish Value Added Tax (% I.V.A.) For purchases out of Spain this tax is deducted. For purchases in Spain, right now the applicable percentages of tax are the following:
- 10% VAT on food products.
- 21% VAT on transport, packaging, extra services, etc.
5.2. "Shipping cost" includes the management of the shipment and the physical delivery of the order from ALBEA BLANCA´s warehouse to the destination stipulated by the CUSTOMER.
5.3. Depending on the type of order and the ordering way, the CUSTOMER may add an extra cost as "packaging and handling expenses" that includes the packing material chosen by the CUSTOMER, within those offered by ALBEA BLANCA, and the management and manipulation of this. The packaging will be specified in writing to the CUSTOMER, together with its price. The different options are the following:
a. Decorated/plane carton boxes. Wrapped or not. With/without extra outside decorations, as ribbons, small items, strings, etc..
b. Decorated/plane bags. With/without outside decorations.
c. Decorated/plane wrapping paper. With/without other type of outside decorations.
5.4. The CUSTOMER must assume in all cases that the prices of the products may vary. In any case, it will be previously communicated.
ALBEA BLANCA informs the CUSTOMER of the existence of a legal guarantee for the products. In case of lack of conformity by default or error of the item sent, the CUSTOMER may choose between requiring replacement, repair of the product or refund of the amount corresponding to the price and shipping costs incurred.
7. Return Policy
7.1. Legal right to desist from the purchase / Right of withdrawal
In the event that the CUSTOMER considers that the product received does not comply with the stipulations of the purchase/sale agreement, he/she has the right to withdraw from the order within a period of fourteen (14) calendar days, without the need for justification, from the day in which the CUSTOMER or a third party indicated by the CUSTOMER, other than the carrier, acquires the material possession of the order.
7.2. Exercise of the right of withdrawal
To exercise this right of withdrawal, the CUSTOMER must notify ALBEA BLANCA of its decision to exercise it before the end of the indicated period of fourteen (14) calendar days, through an unambiguous written statement, indicating its complete personal data and the reference of the order, which may be sent:
a. by ordinary mail, to ALBEA BLANCA´s postal address (Paseo del Pinar 7, 1º izq, 28231 Las Rozas, Madrid, Spain)
b. by email, to ALBEA BLANCA´s general email address (email@example.com)
ALBEA BLANCA will respond in writing indicating the way to proceed.
7.3. All the rights of the CUSTOMER established in the current Spanish legislation regarding the return of the amounts paid are safe, in any case.
7.4. Consequences of withdrawal
a. Withdrawal due to defects/tares of the product:
If the CUSTOMER finds defects in any of the ordered products, he must return the product to ALBEA BLANCA without any undue delay and, in any case, within a maximum period of fifteen (15) calendar days from the date of communication of its decision to withdraw from the contract. The deadline will be considered fulfilled if the return of the order/product at ALBEA BLANCA´s facilities is made before the deadline.
If so agreed in the previous communications on the return of the product, ALBEA BLANCA will send a transporter to pick up the defective product, with no cost for the CUSTOMER. For this it will be necessary that the CUSTOMER prepares the product to be returned in good conditions for its later transport, including all its original wrappings and other articles that will accompany it.
The CLIENT must inform ALBEA BLANCA if there is a change of collection address.
ALBEA BLANCA will return all payments received for the product imperfect or with tare, including the proportional transport costs, without undue delay and, in any case, within fifteen (15) calendar days from the date on which the imperfect product is physically received at its facilities.
The refund will be made by bank transfer, so it is necessary that the CUSTOMER indicates in written communication, its bank account number, the IBAN and SWIFT code, the name of the bank and the account holder.
The CUSTOMER will not incur any expense because of the refund.
b. Withdrawal for reasons other than product defect/tare:
In this case, the right of the CUSTOMER to withdraw from the contract shall apply exclusively to those products returned under the same conditions in which the CUSTOMER received them.
The CUSTOMER will be responsible for the damages suffered in the returned products if they have not been wrapped in optimal conditions for the subsequent transportation.
The CUSTOMER will be responsible for the direct costs of returning the order. ALBEA BLANCA will make its courier services available to the CUSTOMER, for the confidence in the experience that the return shipment is in the terms and conditions that already know. In case of using other means, the CUSTOMER must communicate in writing to ALBEA BLANCA the details of the delivery, and the responsibility of the damages, thefts or loss that may arise, will be from the CUSTOMER.
7.5. The CUSTOMER will NOT have the right to cancel the contract without justification of defect, in the following cases:
7.5.1. Items prepared according to the CUSTOMER's or customized specifications.
7.5.2. Sealed goods, for reasons of health protection or hygiene, that have been unsealed after delivery.
7.6. Review of the returned product
Due to the nature of ALBEA BLANCA´s products, there are established measures to review the returned products. After its examination at the ALBEA BLANCA´s facilities, the CUSTOMER will be informed whether the refund of the amounts paid or the replacement of the product, if any, is applicable.
8. Processing of personal data of users and customers
8. 1. ALBEA BLANCA guarantees that the processing of personal data will be carried out under security levels that prevent its loss, manipulation or unauthorized access. 8.2. In compliance with the provisions of General Regulation (EU) 2016/679, of April 27, 2016, of Data Protection (RGPD) on the protection of natural persons with regard to the processing of personal data and the free movement of This data and repealing Directive 95/46/EC (General Data Protection Regulation) (Text relevant to the EEA) all data provided by the CUSTOMER/USER to ALBEA BLANCA, by any means, throughout the commercial relationship between both, will be incorporated into a file whose owner and responsible is ALBEA BLANCA, and it´s guaranteed that they will be treated with the utmost confidentiality.
8.3. Informative clause that must appear at the moment of entering data by the CUSTOMER/USER:
"In the name of the company, we treat the information you provide us in order to provide them with the requested service and perform billing for it. The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with the legal obligations. The data will not be transferred to third parties except in cases where there is a legal obligation. You have the right to obtain confirmation as to whether illán AB ubago, S.L. We are treating your personal data, therefore, you have the right to access your personal data, rectify inaccurate data or request its deletion when the data is no longer necessary. Also, I request your authorization to offer products and services related to those requested and to retain you as a customer." THE CUSTOMER MUST ANSWER YES OR NOT.
8.4. Informative clause that should appear when ALBEA BLANCA contacts potential CUSTOMER/USER:
"On behalf of the company, we treat the information you provide us in order to send you advertising related to our products and services by any means (postal, email or telephone) and, where appropriate, invite you to events organized by the company. The data provided will be kept as long as you do not request the cessation of the activity. The data will not be transferred to third parties except in cases where there is a legal obligation. You have the right to obtain confirmation as to whether illán AB ubago, S.L. We are treating your personal data, therefore, you have the right to access your personal data, rectify the inaccurate data or request its deletion when the data is no longer necessary for the purposes that were collected." The CUSTOMER/USER can do so by contacting ALBEA BLANCA by email at email@example.com
8.5. According to several articles of Regulation (EU) 2016/679, the data provided by the CUSTOMER/USER becomes part of the "Users/ Customers" file of ALBEA BLANCA.
8.6. Article 5.1.f of the General Data Protection Regulation (RGPD) Regulation (EU) 2016/679, determines the need to establish adequate security guarantees against unauthorized or illegal treatment, against the loss of personal data, the destruction or accidental damage. This implies that ALBEA BLANCA has established technical and organizational measures aimed at ensuring the integrity and confidentiality of personal data, and the possibility (Article 5.2) to demonstrate that these measures have been implemented (proactive responsibility)
8.7. The purposes of the collection and processing of the CUSTOMER/USER data are:
1. Manage the commercial relationship (orders and their collection) In general, the data will be processed to carry out all the activities described in this document, specific to the corporate purpose of ALBEA BLANCA.
2. To respond to requests for information, inquiries and doubts of the interested parties.
3. If the CUSTOMER/USER so confirms / requests, use the data for advertising and commercial prospecting purposes, which involves providing information, advertising and commercial promotions of ALBEA BLANCA products and services. Advertising and commercial prospecting actions may include telephone calls, SMS text messages, emails and postal mails.
4. The data collected by the cookies have the purposes detailed in the Cookies Policy, point 9.4. of Terms and Conditions.
8.8. ALBEA BLANCA considers it necessary for the CUSTOMER/USER to fulfill/provide all the information required in the registration form (both in orders of the online store and those made by other means) In the case of not supplying the data considered "mandatory" by ALBEA BLANCA, it will not be possible to process the request.
8.9. It will be understood that the CUSTOMER/USER gives consent to the use of their personal data for the purposes of advertising and commercial prospecting, in a clear and unequivocal manner, from the moment they are communicated to ALBEA BLANCA, being able to oppose it in the terms indicated below.
8.10. To manifest opposition to receiving publicity (as well as for the performance of any other procedure, including exercise their rights of access, rectification, opposition, cancellation, limitation, deletion, portability and/or revocation of consent, indicating in the case the right you want to request) ALBEA BLANCA offers different ways to the CUSTOMER/USER:
1. Send an email to firstname.lastname@example.org indicating the topic as subject "Data Protection" and in the body of the message the name and surname, and the topic´s explaining sentence I DO NOT WISH TO RECEIVE ADVERTISING FROM ALBEA BLANCA and/or I DO NOT WISH TO RECEIVE ADVERTISING FROM OTHER RELATED COMPANIES.
2. Make a phone call to the Spanish telephone number (+34) 679 431 934 indicating the same data and information specified in the previous option, plus an email address, so ALBEA BLANCA may respond with a written communication.
3. Send a written communication by post mail to Albea Blanca, in Paseo del Pinar 7, 1º izq., 28231 las Rozas, Madrid, Spain, indicating the above-mentioned details, plus an email address, so ALBEA BLANCA may respond with a written communication.
8.11. Personal data will not be provided to external third parties without the consent of the owner, except legal obligation. However, the CUSTOMER/USER when registering also grants the explicit consent to share the data with third parties, when necessary to offer our services. In this respect, ALBEA BLANCA only shares the CUSTOMER/USER data with third parties whose security and data maintenance standards it considers satisfactory and knows that they comply with the data protection legislation.
8.12. The data will be kept by ALBEA BLANCA until:
1. The CUSTOMER/USER causes the removal of the website and/or the ALBEA BLANCA online store.
2. When ALBEA BLANCA considers that they are no longer necessary for the purposes that were collected.
3. When the maximum period of legally permitted time for compliance with these legal obligations is met.
8.13. The CUSTOMER/USER can submit a claim to the control authority if he is not satisfied.
9. Policy of "Cookies"
a) Remind the USER of their access data and the chosen language, among other options.
b) Improve the quality of the website, based on the habits and browsing preferences of the USER.
9.3. ALBEA BLANCA uses the following cookies on its website, for the detailed purposes:
1. Cookies strictly necessary for the provision of certain services expressly requested by the USER.
2. Analytical cookies, for monitoring and statistical analysis of the behavior of all users.
3. Advertising cookies, for the management of advertising spaces based on certain criteria.
4. Behavioral cookies, for the management of advertising spaces according to the specific profile of the USER.
5. Complement cookies (plug-in) for sharing social content.
9.5. Deactivation of Cookies:
All browsers allow the USER to disable the configuration of cookies. These settings are located in the "options" or "preferences" of the USER's browser menu.
a. If the cookies mentioned in 4.1 are deactivated, the USER will not be able to correctly receive the contents and services of ALBEA BLANCA.
b. If the cookies mentioned in 4 (2, 3 and 4) are deactivated, the website may continue to operate without prejudice to the fact that the information collected by them allows ALBEA BLANCA services to be improved and offers many contents free of charge.

10. Intellectual Property
10.1. All the elements of ALBEA BLANCA's website and online store, which are visual or sound, including the underlying technology, are protected by copyright, trademarks and patents.
10.2. ALBEA BLANCA, by itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website and online store, as well as of the elements contained therein (as images, audios, software or texts; and also the logo, combinations of colors, structure and design of their image, selection of materials used, programs necessary for its operation, access and use, etc ...)
10.3. All rights reserved: In virtue of the provisions of articles 8 and 32.1, second paragraph, of the Spanish Intellectual Property Law, is expressly prohibited for commercial purposes, the reproduction, distribution and public communication, including the way it is made available, of all or part of the mentioned above contents owned by ALBEA BLANCA, in any medium and by any technical means, without its express written authorization.
10.4. The USER undertakes to respect the Intellectual and Industrial Property rights owned by ALBEA BLANCA. The USER may visualize the elements of the portal and even print them, copy them and store them on its computer's hard drive or on any other physical medium, if it´s solely and exclusively for its personal and private use.
10.5. The USER must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed on the pages of ALBEA BLANCA.
10.6. In case ALBEA BLANCA´s website provides links or hyperlinks to other websites, ALBEA BLANCA will not exercise any control over these sites or assume any responsibility for the contents of any link belonging to a third-party website. Nor ALBEA BLANCA will guarantee the technical availability, quality, reliability, accuracy, amplitude, veracity, validity and constitutionality of any material or information contained in any of mentioned hyperlinks. Likewise, the inclusion of these external connections will not imply any type of association, merger or participation with the connected entities.

ALBEA BLANCA is not responsible, in any case, despite having adopted all the necessary technological measures to avoid it, for damages of any kind that may be caused by the CONTENTS, as errors, omissions, lack of availability of the portal and the transmission of viruses, malicious or harmful programs.
11. Comments, suggestions and complaints

11.2. ALBEA BLANCA has Spanish official complaint forms available to USERS/CLIENTS.
11.3 It´s the DECREE 1/2010, of January 14th , of the Council of Government, by which the Regulation of the Law 11/1998, of July 9 is approved, the law that protects the CONSUMER in Madrid.
12. Events beyond our control
12.1. ALBEA BLANCA is not responsible for any breach or delay in the fulfillment of any of the assumed obligations, when it´s due to events beyond its reasonable control = Cause of Force Majeure.
12.2. Causes of Force Majeure will include any act, event, lack of exercise, omission or accident, among others, the following:
a) Strikes, lockouts or other protest measures.
b) Civil commotion, revolt, invasion, threat or terrorist attack, war (declared or not) or threat or war preparations.
c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
d) Impossibility of the use of trains, boats, airplanes, motor transport or other means of transport, public or private.
e) Impossibility of using public or private telecommunications systems.
f) Acts, decrees, legislation, regulations or restrictions of any government or public authority.
12.3. It will be understood that the obligations will be suspended during the period in which the Cause of Force Majeure continues, and there will be an extension to fulfill mentioned obligations for a period equal to the duration of the Force Majeure Event. ALBEA BLANCA will use all reasonable means according to its capacity for the Cause of Force Majeure to end, or to find a solution that allows it to fulfill its obligations despite the Cause of Force Majeure.
13. Applicable law and competence
13.1. Current Conditions shall be ruled by Spanish law.
13.2. For the resolution of any doubt, discrepancy or divergence that may arise in the fulfillment and interpretation of this Contract, the parties submit to the Courts and Tribunals of Madrid city.
13.3. Likewise, conflicts with customers resident in the European Union can be resolved through an online resolution platform (ODR), as indicated in art. 14 Reg.524 / 2013 (ODR Regulation)
